PLEASE TAKE NOTICE that, on May 1, 2017, the Federal Trade Commission (“FTC”) and the State of Alabama filed an emergency action in the United States District Court for the Northern District of Alabama against the defendants identified above. As part of the action, the FTC sought emergency relief, including an Ex Parte Motion for Temporary Restraining Order with Asset Freeze and Appointment of a Receiver.

On May 1, 2017, the Honorable R. David Proctor, United States District Judge for the Northern District of Alabama, granted the FTC’s Ex Parte Motion for Temporary Restraining Order with Asset Freeze and Appointment of a Receiver. The court appointed Jeffrey C. Schneider as the Receiver over the Corporate Defendants identified above, along with any of their affiliates, subsidiaries, divisions, or sales or customer service operations, wherever located, with the full power of a federal equity receiver. The Receiver is an agent of the Court. This means that the Court ordered Mr. Schneider, in his capacity as the Receiver, to “take exclusive custody, control, and possession of all assets under the control of the Receivership Defendants, wherever situated.”
